Daniel Montalvo Cases Are Settled

Daniel Montalvo recently settled his lawsuits with Corporate Scientology entities.  The terms of the settlement were not particularly favorable to Daniel, but the settlement provides him: a)  protection from future liability for having taken computer hard drives with him when he left Corporate Scientology, and b) a little something to make his transition into outside life a bit easier.

When I originally posted about the lawsuits in early March 2011, I posted the following comment in response to a number of comments speculating how the suits would accomplish sweeping effects:

I have noted a number of comments speculating on strategies and potential outcomes. I think people should know that this case is Daniel Montalvo’s. His lawyer is a consumate, ethical professional. He is representing Daniel and ONLY Daniel. I am confident that he will do everything in his power to make his client whole ensuring he has the best chance possible for living a productive, fullfilling life. That is his obligation, no other. Whatever path this case takes the fact of it being brought, and hopefully the fact of it resulting in a wrong being justly remedied, will serve as benefit to the public at large and others similarly situated. Anything beyond that is of no concern to me. I would hope others will grant Daniel and his counsel that space and power of choice.

Daniel and his counsel did not consult with me about the settlement before entering into it as was their privilege.  They both felt that under the circumstances, and given the opponent they were facing, they did the right thing for Daniel at that juncture of the litigation.  What they ran into was precisely what Mike Rinder and I informed them they would prior to filing suit; something I don’t think either of them fully appreciated at that time. Nonetheless, having learned the circumstances after the fact, I believe Daniel was well served by his counsel Kit Winter.  Given the hand he was dealt Kit pulled off a minor miracle.

To those who donated to get Daniel out of jail and the charges against him dropped, your intention was fully accomplished.  Corporate Scientology officially dropped charges against Daniel.  To all of you, thank you very much, and very well done.

While Corporate Scientology expressly reserved the right to continue to come after me for something Daniel testified truthfully under oath that I had nothing to do with, you probably already know my response to that: “make my day.”

While Daniel handled his suit as I noted he should in the italicized passage above, he and Kit provided a great service to all of us. They kept the Corporate Scientology legal battalions pinned down for several months; obsessed with staving off Kit and Daniel’s advance made many other advances across the world possible.

Thanks to everybody who contributed, not just money but their time, their homes, their food, their vehicles, themselves.  You truly are appreciated.

Now you’re done and can get on with your life. It was your decision to end it and that’s no small matter……..to end it at cause.     While it’s always tempting to hope for a huge lawsuit settlement, I’ve seen throughout my life that it’s often the better side of wisdom to get THE thing you were fighting for — your life NOT behind bars — and just walk away when that (and some pin money) is accomplished.

    I’ve seen too many people tie up the better part of their lives, suing to break a trust fund, suing an employer they felt harmed them — suing, suing, suing all with that GOLDEN LOTTERY promise of the big bucks.

    YOU will make more money in your life time by stepping quietly into life and finding something that starts out as a spark of interest and grows into a passion … this takes some time and being free from the potential death trap of corporate scientology — you are on your way.

    I was only lurking when Daniel’s name and plight hit the blog. But it was enough of a plight to get me to originate help. What a breakthrough!

    Since that time, it’s been quite an evolution to continually “move on up a little higher.” Nevertheless, we do it day in and day out.

    I was one of those people who donated a good piece of change to help Daniel when he first escaped. Now what I feel I don’t know if whether Daniel had to throw you or any other Independent Scn’ist under the bus to get here? Under what circumstances would he be paid money unless it was to NOT communicate what he knew that could be damaging to cob and his mob or TO communicate something about you and/or Mike or any other Independent that made cob’s mouth water and hands wring at what he could do with that info. I’m just saying that so far this data isn’t making me feel like it’s a completed cycle and these are the points as to why.

  21. Not to take attention away from Daniel’s win for a moment I want to comment on another issue/person written about in this blog earlier. I own and operate an airport and taxi bus in the Clearwater and Beaches area. Yesterday I took an individual named Roe Hubbard (no relation to THE MAN) who, along with two others are to co-hosts of an up-coming Reality Show called “Car-Lot Cowboy.”
    Two years ago George Clooney did a movie called “Up In The Air.” This was based on the real-life events of Tom Stuker who has 10 million air miles in the seat. In the movie he flies in to fire people. In real life he’s an auto consultant. When Spike TV discovered this they approached him on a Reality show. One day he inadvertently opened his mouth and Grant Cardone caught wind of this, stole the idea, raced to copy it approaching Nat-Geo, a smaller network, to slam something into production. (Spike TV committed to 8 episodes believing they’ve got a home-run). Well for Grant Cardone’s fan’s it’s not a good day. His show tanked after just 2 episodes and has been pulled off the air. People in the industry know Grant’s was a rip-off idea and glad to see it go the route it did.

  23. A ‘settlement’ by its very definition is an agreement to give something up in exchange for something else that is worth enough that you are willing to give up the first thing.

    Settlements are always pragmatic.

    Settlements always involve a compromise of one’s original point of view.

    In a settlement, you never get everything you wanted … you judge that you got enough to justify giving up what you gave up.

    Often-times settlements come about because one party is a lot bigger, has a much larger ‘war chest’, has better lawyers, can hold out for a lot longer.

    And, sometimes, settlements leave one party in a worse state than when they started, but a better state (from their point of view) than they were likely to end up in if the matter were ‘taken to the mat’.

    It is impossible for anyone who has not actually seen the settlement document, and been intimately involved in the settlement negotiations and evaluatiions, to offer any useful comment on whether the settlement was a “good one”.

    If Daniel voluntarily agreed to the settlement, after a thorough vetting with his attorney, as a choice he felt was in his best interests, overall … Great! That’s all that counts, actually.

    I think trouble shooters comment is appropriate given details to hand, and that she has a right to at least vent the question considering her involvement and obvious significant support. I too look forward to learning whatever details may arise.

    Regarding Kit. I view attorneys today as a mixture of pirates and knights, tremendous good and bad can be accomplished with the trade, swords and cannon replaced with legal rulings and lawsuits. When a person stands up, using their power and influence in an attempt to do good, without promise of personal gain, especially in this profession, it exemplifies traits that make me feel better about the future of humanity.     It is a completed cycle for him. The purpose for which I asked for donations was to DEFEND Danny. That was unequivocally accomplished. As for me and the handful of others intimately involved in helping him escape both prisons he wound up in, we’ll never be a completed cycle for Miscavige until we are dead in his estimation. Personally, I knew Corporate Scientology would never settle without something (manufactured though it would have to be) to go after me with – and advised Danny and his counsel of this from the word go. Still I posted this from the outset of the civil case, and remained true to it:

    As I noted in the instant post, I was not consulted on all this. That I know as much as I do – and have communicated here – I am sure is the subject of coast to coast sec checks at the moment in Corporate Scientology. It is risky business confronting a sociopath like Miscavige and his destructive cult. But I try to keep my eye on the bigger picture – and that is why my post is presented in the manner that it is. In the broad scheme of things, Independents as a whole are far better off for Daniel’s efforts and our efforts to assist him, regardless of his personal motivations, his gratitude or lack thereof, and the potential consequences to me and the posse. Fortunately, we are all from the school of the hard knocks, so whatever they throw at us that doesn’t kill us just makes us that much stronger.

  39. That is my exact conclusion on the situation. A now completed cycle of action. It did work out in Daniel’s favor completely if he is protected from any kind of future harm that organization or its deranged members might pose. End of story. 🙂

    I was very happy and will always be happy to help defend an adolescent (under 18) from abuses and control of Corporate Scientology. And, I am glad to hear all this came to a conclusion rapidly. Danny is now over 18 and can move on with his life… which is very good indeed.

    As you know, when you are young (under 18), the State has an obligation protect it’s youngsters when their parent’s fail to do so. Which is the story of Danny.

    A civil compromise in an abused youngster’s innocent life vs a manipulative $ billion cult should deserve a second view… a criminal view in my opinion. The FBI can collect the data in Danny’s case and move forward.

    God knows, I could never have stood up against the Co$ when I was 18.

    Anyway, count me “in” on any help with criminal investigations of what Corporate Scientology did to Danny and other youngsters. This is a pattern with young people and I am sure there are more abuse reports. Danny and others like him may have been abused, but they are not forgotten or alone, thanks to you Marty.

However, if has been my private opinion that looking to the civil authorities for “justice” (at the Federal level) is pretty much a fool’s game. The problem is, they have similars of their own.     Reading between the lines. and based on observation of how litigation goes with the Co$, If the charges were dropped, and he was guaranteed immunity from further prosecution, and he told the truth previously under oath, well, fairly obvious what happened. The Co$ let the little fish off the hook, in exchange for something from him that they think they can use to go after the big fish. Nuff said.

    Danny is a brave young man, and I am happy for him that he has managed to disentangle himself from this, even if it came at a price. He has his whole life ahead of him, to regain the years of his youth he lost in that slave camp. We can only wish him well, that he flourishes and propsers in life. I wish him all the love in the world.

    Marty is a truly, truly great person, knowing what he knows, to be able to wish young Daniel well, and for having helped him in the first place. Marty values the young, protects them. Does not use them for his own ends. Marty displays the social personality toward the young.

    Contrast that with a ruthless, anti-social Cult that has no conscience about eating its young, and the picture is clear. If they go after Marty with what they got out of Daniel, they will only end up proving much of what they would not want proven, but they are too damn dark to even see that.

    This, however, clrearly blasts away the few critics who say there is no difference between Corporate Scientologists and Independent Scientologists, that it is just two groups of Scientologists fighting with each other for power.

    THIS clearly shows the massive, difference. Marty demonstrates protectiveness, forgiveness and understanding to a brave young man, even though he knows this young man was used to get at him later (but that will definitely be a footbullet). The Independents, some of whom have cottoned on to what has happened also wish Daneil well.

    Miscavige ruthlessly and shamelessly went after this young man with everything he had, not caring how much he hurt or harmed him.

    My god, what a contrast. After this, no-one can ever have any grounds to say that the Independents are the same as the Corporates.

    Thank you Marty for the further information. It gives me some peace of mind to know. Daniel found himself between the rock and a hard place and then of course there were lawyers involved . . .

    These words “if it doesn’t kill us it will make us stronger” are words of true wisdom and reflect my sentiments exactly. I’d like to share one of my very favorites, “On the day when we can fully trust each other there will be peace on Earth”.

    I wish this for us all.

    The first time I saw this was in a Christmas card. Since then it’s the first thing that comes to my mind when the peace has been disturbed. These words summarize LRH’s works for me. His his reasons, motives, objectives, purposes and goals. I share it with him and all of you who are motivated to greater or lesser degrees to make it so. That includes being able to spot and ferret out where it isn’t being contributed to, that’s just called survival for me and those who share the altertness.

    I wish Daniel well and hope he finds peace as he creates life. He’s in many ways a child yet he’s been through enough in this youthful stage of life to qualify him as an old man by now. He’ll do fine.

    and you’re still here Marty so you must be feeling like a superhero by now!!! Hell at this point King Kong has NOTHING on you.

    I second WindHorse’s statements. You need and deserve a life filled with choices and opportunities that can fulfill you. I hope your pin money is sufficient to get you through whatever steps it takes for you to become established in your new life. This is a very large playing field and every player needs to do their own part, and they are the only ones to know what that is. Overall it is a war, individually there are battles. Congratulations on winning yours. I wish you the best of everything good life has to offer you in the years you have ahead of you.
