Abuse of Process – David Miscavige

Abuse of Process is a civil violation of law.  An Abuse of Process is accomplished when the court’s processes are used for an improper purpose – a purpose other than that which a party purports to use that process for.

In my professional opinion David Miscavige has used the Bexar County District Court for purposes that are improper and fraudlent.  That is assuming that the Tampa Bay Times has reported straight facts this evening.

The Times reported on the Scientology Inc v. Debbie Cook case as follows:

 The agreement dated Monday allows both sides to essentially call it even and go their separate ways. Neither pays the other side money, and Cook and her husband are legally prohibited from ever again speaking ill of the church.

I am willing to bet everything I own that this is a blatant, outright lie lodged with the court for the purposes of making David Miscavige somehow look innocent of the testimony laid on his ass on 9 February 2012: Debbie Cook Testimony

Since David Miscavige has instructed his lawyers to fraudulently use the court’s processes to lie in order to cover up his serial criminal acts committed against a woman, I will weigh in with my professional opinion.

You can take it to the bank that Miscavige agreed to pay Debbie Cook and Wayne Baumgarten seven figures, at least two times – and possibly three times  – over to make them go away.

In fact, I have bet everything I have on it.  That is because if I am wrong, David Miscavige has every means available to haul me into court.

Bank on it that the bitch won’t bring it.

Bank on it also that I will stay on this like white on rice.

Do we think she has enough backbone to follow through, or do you think because of the settlement offer she won’t be “allowed” to even give us our money back because that proves that the devil and the Church of Scientology paid her off?

    Anyone who has ever been involved in litigation knows what went down. Miscavige paid to stop the pain. He also apparently paid to cover up the fact that he paid.

    Had they simply done the usual “The case has been settled, the terms are confidential” it would have been one thing. To file a document in the court as a “PR cover” that tries to create a false picture is a new one on me — but par for the course.

    So, I concur with you 100% and the bitch can come after both of us. Unlike him, neither you nor I have anything to hide.

  9. Cook said her testimony represented only a small part of what she wanted to say, “the tip of the iceberg.” I wish we could have heard the rest in open court! I think she should have pushed for the whole truth to come out as the gag order was done under duress I wonder if she had more duress to continue the gag order?

  10. SIgh! This makes sense. There is no other reasonable explanation that fits the facts. What in the world would Debbie have to gain by simply taking her ball and going home and then agreeing to drop her Facebook Page, not associate with the Indy’s and no speak out about the Church? Correct if you daid nothing, UNLESS, there was money on or under the table. Settlements outside of the Courts are not uncommon with settlement agreements making only vague statements about the conditions. Something like, neither side admits ANY culpability and have agreed to settle their disagreements according to their respective interests.

    In this case, as Marty says, likely 7 figures to go away. If this is true I do want my dough back and I WILL be unfriending Debbie and WAYNE from their non existent page.

    I was truly disappointed that the trial was not able to continue and more truth come out. That Debbie once again entered into a confidentiality agreement with the Church places her testimony out of bounds for future reference in other court actions, as it can no longer be corroborated. It is now just hearsay. It cannot be used to help Heber or any other denizens of the “hole.” The continuation of the trial was an opportunity to buttress her testimony with more instances of civil rights violations and crimes and introduce many more witnesses. Debbie may have won her personal battle with the help of the Indies, but the real battle, that of creating a church that lives within the laws of the land, was not. Debbie sold us out for “30 pieces of silver.”

    That Debbie’s story was able to come out is a win. It portends more future revelations of truth if the Independent community comes together to help fund the next worthy combatant of DM dirty deeds.

    You are on the cutting edge of the sword of truth. Keep up the fight. Your efforts are appreciated.

    Debbie didn’t speak ill of the church. She spoke of facts regarding David Miscavige’s actions, orders and leadership. The wording above again makes it look like DM is not in the wrong but just a poor little innocent no responsibility nobody that is being abused and lied about.

    Here is my take for what it has occurred these past few days: David Miscavige has won and lost. He has lost more because he had to pay $$, once again to another victim of his overts at a likely higher price.

    There is much antagonism to Debbie on this blog that she “sold out”, and that is understandable. I believe she delivered a very effective blow on the email she sent on New Years Eve to shit loads of people under the radar, and we are still seeing this effect today. Debbie was not able to take that to the limit, so to speak,

    Finally, I am quite certain we will not hear from her again, As Marty points out, end of Session. History does have a way of repeating itself. Particulary in the Church of Miscavige.

    The Times doesn’t say whether the “document” they have is the settlement agreement or some other falsified tall tale. It looks like a falsified tall tale. The Times should have published the fact that it wasn’t really the settlement agreement. The church gave them horseshit hoping people will think it is chocolate pudding. That’s the real news story. Miscavige is guilty of Abuse of Process if he produced such a falsified document to falsely make himself look good at the Court’s expense. The Times should have pressed the Church for a copy of the settlement agreement….all the truth all the time. Publishing DM’s lies doesn’t help.

  36. Having been in touch with Debbie on and off over the last few months, I know that her health was failing. Debbie and Wayne were having a very rough time. They greatly appreciated the many people who stepped up and helped them with they were in a bad spot. Without that help, they would have gone under very quickly.The real truth that came out in Debbie’s testimony almost never come out. Indies made that happen. This was a big win for the Indy movement. This did not happen because one person spoke out. This happened because a large and determined group decided to make it happen. So Debbie is a broken piece now. Probably she was broken before this all started. The fact is that it was the Indie movement that kicked suppression right in the teeth. That’s what happened, that’s all that happened. This chapter closed. Another chapter will open. This skirmish is over and it made quite a dent. Take a win. Kudo’s to Marty and Mike.

    Debbie did what she did. I contributed to that motion with full awareness that some sort of settlement was far more likely than not.     I read the Tampa Bay Times report and it was an awful long stretch to swallow that Debbie had “settled” for no money and a reinstatement of her “gag order” and an agreed disconnection from anyone who has supported, or will support her original purpose to “reform the Church”. I simply could not reconcile it from my viewpoint.

    That David Miscavige has apparently put his own evil twist on the information that was released regarding the “agreement” is in total alignment with his inability to forward ANY truth, and his inability to withhold himself from suppressing beings of good will any way that he can get away with.

    But for me, that isn’t what I see as the most significant part of this blog post. It is your unequivocal “all in” stance that shook the rafters of my complacency.

    People like Amy Scobee, Mat Pesch, Nancy Many, Chuck Beatty, Jesse Prince, Mark Bunker, Tory Christman, and Jeff Hawkins who have never wavered and are still doing what is right. There are many more out there.

    And all those who contributed to help Debbie and Wayne defend themselves and who answered the call to action when it was needed, not expecting anything in return. It is good to know that when others leave the suppression, they have a safe harbor to turn to in their hour of need.

    All these people decided that their personal integrity, the human rights of others and the truth was more important to them and valuable than the money that DM conned out of people of good will.

    DM thinks that everyone has their price, but he is wrong and that is why he will eventually fail.

    Not everyone will accept blood money.

  49. There is no sens of the muselment of Debbie and Wayne. It is a huge outpoint regarding their determination to tell the truth about the corporate church of $cientology gulag and abuses. There is two hypthesis : i) they received a huge amount of money and so they sold their souls and all the indies and friends in the same occasion, ii) she and her husband were sort of PDHed or threatened to death or something crazy of that category… One should made some research to discover the truth and bring Davey to justice so that he can be put on a «black hole» for ever.

  50. I have compassion if health issues led Debbie to say “enough” on this.

    However, will that decision buy peace? What will it be like to know you can’t talk about certain things, even in conversation? Whether she traded her freedom for money, health, or a reach for peace, she still traded it. She is again a prisoner to corporate Scientology.

    However, in the course of getting to where we are today, Debbie showed courage, integrity, and a willingness to tell the truth about DM and abuses. Let’s not forget that, and let’s do remember that we will probably never know the factors that led to this settlement. If we knew all the facts, Debbie might still be a hero (okay, heroine, for any traditionalists).

    It seems to me people may be feeling a secondary or failed purpose on this. Be patient. The river of truth is powerful enough to keep flowing.

  66. Let’s not denigrate or harshly judge Debbie just yet. Let’s remember her original truth-telling email and her obviously sincere court testimony. There is lots of missing and conflicting data here. Debbie and Wayne “settled” for no money? What exactly then did they gain? Freedom from being sued for a gazillion dollars they don’t have? I think that there is a very high probability that Marty has called this one correctly as far as the money goes. So then, what would be her motive in accepting it? A couple of million dollars? Not that this couldn’t be true, but it is not congruent with her January 1st email, not to mention with her quarter of a century or so of dedication to forwarding LRH tech in the Sea Org while earning peanuts in money. Maybe I am naive and overly trustful, but I have the feeling that there is more here. Much more.
    …..And I also have a feeling that the Devil is in the details.
    I don’t think that this thing is over yet. Not until the whole truth comes out. And it will. So, why don’t we all just keep looking at this puzzle with our x-ray vision until the whole picture comes clear.

  67. What happened with Debbie Cook was a disappointment because she dropped many points of the code of honor. Some points: Never desert a group to which you owe your support. Never compromise with your own reality. Your self-determinism and your honor are more important than your immediate life. And Your integrity to yourself is more important than your body.
    Yes she had body problems but to give up and take the money from the same SP? She said it was wrong to do it in the first place but was threatened ,now she was free so what is her excuse? Under the agreement she wont be able to explain herself…

Biggest mystery to me still is that some one, ANYONE, can have their inalienable right, not to mention their Constitutional right, to communicate truth stopped or impeded.     The only person who lost anything here was Debbie. She had the chance to be great and yet she chose to be small. I wouldn’t want to be the one who has to live with those choices for the rest of my life – I like to be able to look in the mirror and I like to have real friends who I can look in the eye.

    Many, including myself, had a wrong estimation of her. (Hence the disappointment.) Making a wrong estimation is my error. I have been willing to ignore outpoints (like omitting her own participation in the overts and crimes she had labelled or other points of weakness). Maybe a weak point of the social characters amongst us to rather concentrate on the good, pleasant or what fits to our wishes. This is what I learn from it.
    As far as I am concerned, my help is still there. There isn’t anything that can’t be undone or forgiven.

  74. When Debbie was in the middle of it all I have decided to help. Help her, our cause and truth. I was going to send my donation. Then, I had a consideration on this. I wrote her a letter. I add it here. It speaks for itself and seems to be more relevant now. I sent it on her web page. I never got a reply of any kind, not even short ack that there will be a reply in future. I did not like it. I knew she was very busy but she could at least relate. Marty is a busy chap (I bet!) yet he relates and replies, to less important mails, as well he can, and shows care. This, to me, is huge credit. After not getting any reply for some time, I sent my donation to Marty instead, to use as he pleases. And I felt great. (And the fact that it reached him was technically a miracle, as he and I know…so it seemed even more right). Here is the letter: “Dear Debbie,
    1st of all congratulations and well done, for standing up for truth, sanity, ARC and the Tech.
    Your recent activity was a brave and Theta activity, and it touched my heart and my mind, as it did with many others. Although I do not know you, I did consider donating to your defense. Then I had a 2nd thought and felt I needed to clarify something.
    I am a scientologist in good standing, (still). I have had my own “horror story” in the past, as well as observing outnesses and departures from justice and ethics tech. and LIES…So I just stayed away.
    Then I discovered the independents and am trying to complete my doubt formula.
    Please do not see in the following an attempt to judge or evaluate for you in any way. It is not!!
    My clarification:
    For many many years you were a strong part of the organization which was doing everything you now recognize as false, out-ethics, out-policy, abusing and harming Scientology and scientologists. And you went on, not only accepting, but being a top executive in the system which enhanced these things. Not long ago I read an account of an Italian lady (Maria Gardini) telling about extreme and un-ending regging cycles in which you were having a major role, doing exactly what you now denounce so strongly, over regging and distressing this person, to put it mildly. There must have been other similar things. I know, Marty, Mike and others are in same position. But I think they are taking responsibility seriously, and making amends impressively each in his own way. They were beating and abusing people…BUT they came out with it, disclosed it and confronted it all. What about you?
    I am a public. I did contribute to Scientology in my time. But no doubt it does not amount to 1/100 of your contribution and years of service. And as I said above, and will repeat again, I have no right nor will to judge.

I have heard of (non-Scientology) cases in which people were paid off by the other side buying a profitable company and handing it over to them. Each side can then claim to be untainted by anything as degrading as money.

    If this is precise surely one can deduce: Cook and co know things the Church of Scientology does not wish others to know.

    Based on the fact the church of scientology sought such an agreement one can deduce they would have no other reasonable legal recourse were Cook and co to reveal what they know other that said order, meaning it presumably would be difficult if not impossible to disprove the veracity of said knowledge.

    As with Jan Eastgate, were there no actual guilt surely the accused, Jan Eastgate or the church of scientology, would want their day in court to clear their names?

    In this case both parties, certainly Jan Eastgate, seems to think the turn of events shows their innocence. It doesn’t and if anything this very attitude displays guilty relief rather than innocence.

It hasn’t been verified for all to see that there was any such signed agreement filed with the court. If so, let’s see it and let’s see who signed it.

    If Debbie and Wayne really agreed to be quiet and become invisible in exchange for the corporate church to drop the lawsuit, then that would seem to me to be very foolish indeed. If they had really agreed to accept a substantial sum of money for their silence while at the same time saying they had not accepted any, that would seem to me to be beyond foolish.

    Personally, I’d like to have seen the ‘rest of the iceberg’. Given what is truely at stake here, the existence of the tech, the good name of LRH and Scientology, the reformation of an organization which is capable of enormous good for us all, to me that would outweigh concerns of personal comfort.     A perfect Hollywood ending.

    As to the church, what will become of it?

    So many prophets and wise man tried to explain this concept of eternal truth but it is not possible to communicate it:

    Any space, energy, form, object, individual or physical universe condition can exist only when an alteration has occurred of the original as-isness so as to prevent a casual view from vanishing it. In other words, anything which is persisting must contain a “lie” so that the original consideration is not completely duplicated.

    Thats why the “concept” can’t be grasped in such a way that it could be well communicated. And this concept isn’t even physical (mest) which makes it much harder to grasp.

    Any religious, theological, philosophical teaching is an alteration of the original concept. That’s why we have so many different “schools” in Buddhism, so many Christian branches and other religions.

    The only thruth there is, is the truth we find ourself.
    I am not a religious man. No more.
    Not in the meaning of the word as it is used today.
    I do like all religions and viewpoints. I talk to people of all religions about their beliefs. And this is an interesting journey.
    Scientology is a helpful tool on the way to truth. Without it I wouldn’t have started yet. 🙂

    Debbie sends an email to her list of friends. Email is considered to be a private messaging system. Her message was to CHURCH Scientologists in good standing. Had it been otherwise, she would have posted on a public website. She obviously knows how to set up a website and post to it.

    The email was given to the media by someone. She did not give the email to the media. She is prosecuted by the Church. I do not think that she ever intended to go public via media and this blog and other media outlets.

    Even as she accepts assistance from the Independent field, she publicly states that she is a Scientologist and that she subscribes to the philosophy, policy and aims of Scientology. She does not indicate a disagreement with the existence of the Sea Org. She does not indicate any interest in the total destruction of the Church. She indicates she wants to follow LRH policy. She is VERY upfront about it. The donors were given a head`s up as to her intentions. LRH policy is very clear even early on as regards to speaking ill about the Church or Scientology.

    I`ve carefully read the articles about the settlement. There is no statement to the effect that she has been given money. That is pure speculation.

    Did she do what SHE intended to do is the question here. Others jumped aboard with their own intentions and the Church stupidly acted in ways that forced her into acting against the Church, something she publicly stated she did not want to do.

  155. Yesterday I was unhappy about Debbie’s settlement. Today, well, is a new day and time to get on with it. In closing this out for myself, I can’t help but wonder if her escapade of 3 1/2 months, wasn’t entirely self serving. Time will tell.

    Each independent scientologist is the ruler of his own kingdom and we work together freely as we agree to work together.
    We don’t need no stinkin followers…we each need to lead our own dynamics.
    There’s a tremendous amount of room for co-operative action. But it’s just got to be from a level of personal responsibility.

She sent her e-mail, she testified in court, she reached millions through the media. She got off a comfortable stool and hit Miscavige where it hurts and did damage that will never heal. Miscavige (and the little cult that he is running) grows weaker and weaker and will never recover.

    Debbie pushed herself VERY hard for decades. I’ve known Debbie since the 80’s and when I saw the recent vidoes of her, I could see that she is mentally and physically worn. I can forgive her for taking the fight only so far.

    Debbie isn’t the target. Miscavige is the target. It’s the responsibility of all of us to continue to shine the light of truth on his dark soul…..

However, your question “will that decision buy peace?” made me think – I’m not sure that accepting money from a corrupt dictator in exchange for silence, or to get rid of a problem, and letting down your comrades in arms, is likely to improve health – at least, long term. We know that betrayals like that have a way of biting back, because of the basic goodness of the being. I sincerely hope this is not what happened here. I have, and many who participate here also have, a great deal of affinity for Debbie and Wayne. I want very much to believe it was not misplaced.

  196. Settlement agreements, normally, dictate what can, and what cannot be said in public about the settlement. A settlement agreement can, on the one hand, be so extreme as to prohibit both sides from saying anything in public, or on the other hand, the settlement agreement can actually be published widely. It depends upon, basically, what the parties to the settlement agreed upon.

    There is no way to know what the parties agreed upon, and certainly the Tampa Bay Times has no idea, unless you actually read the settlement agreement itself.

    And, people who are not parties to the settlement agreement can say anything they want about it, guess about it, characterize it, imagine what it said, assert they are sure it included a provision turning the Sun red, for example … speculation about what the settlement agreement said, or who paid who … is everyone’s right. Speculate away. Give it your best educated guess. Miscavige can’t sue you for guessing — AND unless the settlement agreement specifically forbids him from characterizing it in public, he can say what he wants about it. The only person who can complain, legally, about his violation of the settlement agreement … is Debbie Cook.

  199. If I am understanding the published document correctly, it is not a “settlement agreement” as such. It is an “injunction” issued by the court on it’s own terms, but with the agreement of both parties. Presumably it was negotiated with the Judge behind closed doors with both parties present.

    There maybe a separate “settlement agreement”, but we don’t even know that such exists, or under what circumstances it was negotiated, if it was negotiated.
