Super Ponzi – Miscavige Speaks

Ok, the ante has now been upped. 

Here is the vetted transcript of Miscavige’s response, internally, to the St Pete Times’ 2006 story about the Super Power building delays.  Vetted by Miscavige’s secretarial pool to delete the long string of foul, abusive language, and to put “[  ]” where MCPHERSON CASE was uttered.  

And you thought Mike, Tom, and I were kidding about the groundbreaking  being done at Miscavige’s order solely for the purpose of diverting attention from the McPherson case?

How about his intent to “create as big a mess right next to City Hall as possible” by buying up and prettying up as many buildings as possible in downtown Clearwater?  And note that all of the construction and renovations is aimed at proving things are flourishing and prospering for PR purposes — no intention to get the Super Power building done so any delivery can occur.  This is why the city has such a  jaundiced view of the white elephant Super Power building still sitting there incomplete. Tens if not hundreds of millions have been spent on other properties while the white elephant grows mildew — all projects that began years after the “Mecca building.”

How about his frothing contradictions: the St Pete Times are writing to his public, then in the next breath it is the anti-Scientology public?

How about his thinly veiled, and suppressed, rock slam on the terminal Joe Childs (Managing Editor of the St Petersburg Times)?

How about his oft-heard complaint about anything that is delayed “you have forced me to do it because you are incompetent [though I will not approve anything you send me so you cannot possibly get anything done] and now I am so overloaded doing everyone else’s job that it is impossible for me to get it done.  So, that’s proof YOU delayed it.” (While the latest submission has been sitting in his office for 6 months untouched). 

Incidentally, if anyone has been ripped off for plenty on the Super Ponzi in recent years – and wants to do something about it – please email me.

  Let me tell you the problem with this: A complete delay on completing cycles of action in Clearwater. Flourish and Prosper is the way to go.

 You forget that back in `98 with all the [__] stuff going on, I made sure the building got announced. It squashed things for a while—even with the criminal case.

 All of this does come down to just crap execution on construction planning and so forth.

 In other words, even though you don’t think so, the main priority is to get the renos done on these different buildings. Everything from the Hacienda and the Sherwood (so they look like the best apartment houses in town—which they will), to the Oak Cove (and create as big a mess right next to City Hall as possible), to the Mecca getting rolling, to the FH.

 Putting in a call to Joe Childs is a virtual waste of time. I don’t know who these people in the St. Pete Times are writing to, but they obviously think they are writing to our public. What would any local person give a damn about a piloting of a Super Power rundown? They wouldn’t. So it’s become quite clear: The St. Pete Times is not trying to inform their readers (there’s not a Christian in town who would give a damn about that article) and they must think they’re just writing for the anti-Scientology crowd. That is who they are writing to.

 The answer is to actually start getting some dones on the expansion. And, as far as filling the vacuum with these guys, you have some new op on always using external public. Most of Ben’s answer is he “refuses to talk about it.” I don’t know a goddamn thing that’s confidential about the Super Power in terms of people training or whatever. And so some mystery is being created and there’s just 1.1 lines from Farley on this.

 The big withhold is that Int has stalled the construction so much and still has it completely over to me. Your handling is no handling. I could think one up with Joe, but why bother. Why don’t you? 

Abuse of Legal Process

The story linked here is a real time example of how Miscavige (and yes Miscavige engineered every illegal step of it) uses money to abuse the rights of people and prevent them from any possibility of recourse.   Mark my words, if Miscavige doesn’t back off on this now this saga is going to get a whole lot more ugly before it is over.

How Miscavige Killed Church Management

In January 1996 when I returned to the Int Base after two years of tech training at the Ship and Flag, Miscavige was well in progress on annihilating church management.

First, Miscavige was in the process of  busting Marc Yager off CO CMO INT/WDC Chairman and spent three years attempting to turn the man into a mouse.

Second, Miscavige had nearly all those who remained in Int Managment working on an evolution as massive in content and as destructive in result as Golden Age of Tech.  In his Stalinesque style Miscavige dubbed it New Era of Management. Like GAT, NEM consisted of endless binders of  Miscavige written and/or directed and approved material. Just as GAT forever altered and replaced LRH tech, NEM forever altered and buried LRH admin.

Miscavige had teams of key executives for Upper Middle Management (Int Liaison Office which he had previously dubbed Flag Command Bureaux which was originally back in the day of LRH called the Flag Bureau) and for every Continental management office up at Int Base for months preparing to fire to implement his grand NEM scheme in one, sudden, implant-like fashion.   Those involved in that evolution are well represented here and I am sure can fill in some of the details of their engramic several month Q and A “briefing” period.  If the “trainees” or “Missionaires in briefing” learned anything it was these two lessons that were implanted with an atomic branding iron:

a)  Miscavige and his NEM issues were senior to LRH and his virtual books (in the form of Flag Orders and Central Bureau Orders and OEC) on management.

b) Scientology did not exist at the International Scientology Headquarters.

 Third, the international tech heirarchy was effectively made leaderless by the busting of Ray Mithoff from the post of Senior C/S Int.  Oh,he retained the title, but he was made a mere figurehead (just as Heber had been made as President CSI and Guillaume as ED Int as early as the eighties).  Dan Koon was put on as Snr C/S Int Chief – administrative head of the Snr CS Int Office. Once DM effectively dead agented Ray with all Int tech terminals (including his own Snr CS Int office) Dan was posted elsewhere – and Ray from thereon out was nothing more than a figurehead (Note: Dan had no knowledge and played no part in the Miscavige Op – Dan is the last person in the world who would engage in denigrating a person into oblivion).

Next Miscavige appointed Mark Ingber as CO CMO INT/WDC Chairman.  Through continual barrages of verbal cross orders to not only LRH, but even to his own NEM, plus beatings and invalidation, Miscavige soon destroyed Ingber. 

Miscavige replaced Ingber with Jenny Linsen Devocht.  Through the same methods that he had destroyed Yager and Ingber, sans the beatings, he destroyed Jenny.

Miscavige replaced Linsen with Wendell Reynolds of Int Finance Dictator fame.  But Wendell soon went the route of the other who preceeded him.

By the time Miscavige had made mincemeat of that troika, Yager had graduated the RPF (1999) and he was thrown back into the fire.  By then,  CMO Int and Exec Strata were choked by so many restrictions (such as no evals allowed; no programs that did not push NEM and Golden Age of Tech allowed) that International Management had become a mere functionless title.  To ensure no management would emanate from Int, Miscavige assigned the entire Int Base lower conditions from which they never were allowed to emerge.  Yager was declared SP, as were a number of Interntional managers, as were Mike Rinder (while WDC OSA) and I (while on the post of IG), as were a number of other Int base execs; all ordered by Miscavige, all while we continued to occupy our posts. 

By the year 2000, Scientology Management was dead.

The proof of the pudding is the current scene.  Here it is in a nutshell:

Marc Yager is still holds the title CO CMO INT/WDC Chairman.  But there is no CMO INT nor WDC, with the exception of Angie Blankenship who holds WDC Ideal Orgs. But Angie doesn’t answer to Yager; she reports and answers to Miscavige.  Yager has been reduced to being a preps boy (culling pc folders and ethics folders at Int to find lurid details on the likes of us) for Dan Sherman (LRH Biographer) to write “freedom mags” and the myriad anti-Marty sites OSA has its operatives pretend spontaneously appear.

Yager does not even report to Miscavige, because Miscavige cannot look at him without leaping at him and pummeling him to a pulp every time he is in his sight. So, Jenny Linsen (whose post title is D/CO Production CMO INT) actually forwards and all communication between Miscavige and her nominal senior Yager.

Miscavige bypasses whatever is left between Int Liaison Office (Upper Middle Management) and Continental Liaison Offices and orgs by directly running every CO CMO Cont.  That is right, he receives weekly reports routed directly to COB RTC from each CO CMO.  The reports report on stats for each continent and org (as in Ship, FSO, PAC) where each CMO unit is located.  Miscavige then whips out his dictaphone and rattles off weekly orders to the CO CMO’s on a purely stimulus-response basis.  And that is what he calls management. Anyone with the slightest training or understanding of LRH FO and CBO and HCOPL tech recognizes that I do not exagerate when I say that management has long since died, and there is no such thing as management any more.  There may be bodies at the CSI Management building at Hollywood and Ivar, and there may be bodies in CLOS, but per HCO PL Danger Conditions, Why Organizations Stay Small – with such long term and thorough bypass, they do not in fact exist.

To exacerbate matters Miscavige utterly bypasses Snr CS Int Office, Tech and Qual bureaus Int and Cont, and even tech heirarchies of orgs such a FSSO and FSO and AOs by virtue of running all tech matters through his RTC rep NW.  They too write weekly reports to Miscavige and he replies to each one – when he is not too busy skiing, scuba diving, or attending premieres with celebrity pals.  Most of those reps have never audited a single grade on another person, nor even C/S’d a person up a single grade or level of the Bridge.

RTC at Int is reduced to nothing but service facilities for Miscavige – communicators, secretaries, mail clerks, stewards, maids, chefs, etc – and Warren McShane who handles “Legal”.   Incidentally, some wonder why OSA has become a toothless shadow of a network.  That too is answered by HCO PL, Danger Conditions.  DM and Warren have bypassed them, directly hiring and running an outside intelligence apparatus to “monitor” my “activities.”   And they are incompetent beyond belief.  Meanwhile whenever OSA does through blood, sweat and tears establish an intelligence line in my general vicinity, Miscavige blows it by ordering some knee-jerk (completely stimulus-response)  “expose” on Marty and Mike; expose’s that are so thoroughly chock-full of embellishment and lies they have zero impact.   And so,  the last thing Miscavige used to be able to rely upon (a network that at least could make people afraid of him) has also been decimated by Miscavige himself.

By the way, since the late nineties the one corporate and ecclesiastical post that could anything about this state of affairs technically has been usurped also by Miscavige. The CO Church of Spiritual Technology (CST, which holds an option to shut down and take over RTC’s function in the event of this level of departure from RTC purpose and function) Russ Bellin had been Miscavige’s project manager for such important matters as the Mark VIII E-meter that has been rotting in a warehouse for five years (and will likely remain there forever), and building unbelievably expensive CD and transcript productions lines (which are largely superfluous in this day of downloadable audio and video).  That all ended a couple of years ago when Miscavige (as is his habit) decided everything Russ did (that had been heavily promoted by Miscavige as being the only competent products on his lines) were all Overt Products (even though Miscavige publicly basks in the glory of them to this day).  Miscavige busted Russ to Int Finance Director, after he found out the previous IFD (Wendell Reynolds) had secretly financed the blow of an Int Staff member (God bless Wendell after all).

Russ got tired of  two years in the hole and this past spring made a break for it.   Unfortunately, his foot kicked the fence on his way over, and he was quickly apprehended and returned by Gold Security.

Miscavige has kept CST in check by a loophole he found in LRH’s estate planning that sought to guard against Miscavige’s type of destrcutive dictatorship.  That is, CST officers and directors must remain in good standing with the mother church CSI in order to qualify for remaining in CST.  DM controls CSI with an iron fist, and the moment anyone in CST shows the slightest sign of stepping out of line, why, Miscavige simply arranges their dismissal from CST into a lower corporation like CSI – as he did with Bellin.

Perhaps all this sheds more light on why I have no hesitancy in pronouncing the church’s death.

This true state of affairs is why I have been directing my attention more and more towards the future.

Worrying about the church, or hoping for its salvage, is a collossal waste of time and energy.

It is dead.

Know your rights

 

To: Executives and staff of Int, Gold, OSA, etc

Know your rights.

I know you have heard horrific things about how former staff who left the church with evidence in their possession will be prosecuted . You should know that that is propaganda.

That propaganda is directed to one public and one public alone: YOU.

And it is FALSE PROPAGANDA.

The intent of the propaganda is the same intent behind forcing you to periodically sign five year employment contracts which make you think you have signed your rights to free speech away.

The purpose is to keep you in a state of electrified fear of ever even thinking a negative thought about David Miscavige and his rein of terror, let alone ever doing anything about it.

Now, let’s get to those rights of yours that you probably don’t know  about.

In the United States of America, and in most civilized nations, one cannot sign away his or her freedom of speech. The fiats of David Miscavige do not trump the Bill or Rights nor the Universal Declaration of Human Rights. Miscavige’s bloviating does not even have the slightest effect upon settled California case law.

So, no matter what you have signed or been told to the contrary, recognize it has no effect upon the following settled law:

If you harbor intentions to leave, and you have a reasonable belief that the church might pursue you in order to coerce you to return to some form of environment where you lack the freedom of movement, speech, or association you have the right to take with you evidence that supports that belief.

If you believe people who were once in your position, who have already left, are being attacked by the church in order to coerce them into giving up any of their rights to free movement, speech or association, you have the right to take with you evidence of infringement of such rights.

If you are leaving because you reasonably believe you have witnessed crimes against persons or acts that have denied people their God-given rights to freedom of speech, movement, or association then you are within your rights to take with you evidence of those crimes and/or denials of Civil and Human Rights.

If any doubt exists as to whether you will be protected should you choose to exercise these rights, I personally guarantee you protection. The legal minds available to protect your rights on the outside make Miscavige’s overpaid criminal cover-up artists look like the pikers they are.

Miscavige is less and less seen by the average staff member because he is figuratively burrowing himself further and further into his Hitlerian bunker. He has good reason to choose his ground hog strategy.

His rein of terror is under intense scrutiny by people who make their lives’ work to end effective slavery and mafia-like intimidation tactics by dictators.

Which leads to the next bit of propaganda you would be ill-served to heed. That is the notion being broadcast within that Miscavige is being hunted by the forces of evil on the planet. Quite the contrary, those investigating him firmly hold to the view that Scientology is a religion entitled to its own protections under the First Amendment to the United States Constitution.

The fact of the matter is the biggest threat to the viability of those protections for the future is Miscavige’s continuous crimes committed in the name of the religion.

Think about it.

Or, if you cannot confront thoughts along those lines, try not to think about it.

 

The Legacy of the Tech

 

For the past several days I’ve been sharing some thoughts. To some it evidently sounded like reactive venting. In fact, for the past two weeks, and throughout this thought-sharing period, I have been auditing others and solo auditing daily and I believe I have been expressing emotion appropriate to the circumstances I face. While I meant everything I wrote, I was also conducting a differentiation drill and a roll call or sorts. The former is important from time to time in order to pursue the larger goal successfully. A number of OSA Intelligence Black Ops lines were revealed and rendered ineffective in the process. Further, one learns in Scientology training and practice that the biggest lie in this universe is that we are all one – all the same – a=a=a. People who day in and day out promote the idea that we are all the same, we are all headed in the same direction, and thus every misdirected entheta attempt to cave people in is A-Ok, are on a more subtle level accomplishing the same goal as Miscavige’s.

The latter (roll call) came to me from an LRH Guardian’s Office Order, later converted to an OSA NW Order, in which he told of the Swedes’ success in World War Two to illustrate and convey the datum: small groups, well organized, and with a higher purpose can defeat the largest and best armed armies. You don’t survive a billion dollar war machine directed at your head by holding hands and singing Kumbaya.

I extend a heartfelt thanks to those who answered the call on back channels as well as here.

For those upset that I am not issuing orders, realize I am not trying to create followers. I am trying to create leaders. Originated, effective action that aligns with shared purpose is what is called for.

I truly believe that for any of us to make it we must as individuals walk through the valley of the shadow of death alone. Only through that process can one be certain of his or her own state of case, untainted by a 1.1 cult culture organized to create cloying, unquestioning followers. Those who have gone through that experience in life are those whose counsel I most value.

I know this sounds esoteric and vague to some, and blasphemous to others. But, I think that is partly due to residual left over from the C of M implantation of Reverse Scientology. The group think that says we must have a certain structure, we must have clear-cut direction from above, we must have a hierarchy that tells us which way is up, we cannot entertain an independent thought – and Lord forbid, a created thought that does not align with what we have been told we must know in order to conduct our lives properly.

As far as what Scientology can achieve and where it leads, I happen to agree with LRH’s description of LOGIC ONE (from the PDC):

Now in view of the fact that Scientology is the science of knowing how to know, we have to have some definition of knowledge. Now these logics as they are written here have to be rewritten slightly for the echelon of Scientology in which we are operating, which is to say the make-break of universes.

Logic One is knowledge as a whole group. There are lists of these around, in these various books. Knowledge as a whole group or subdivision of a group of data or speculations and conclusions on data or methods of gaining data. That pins knowledge down as data. And that’s true for homo sapiens. And that is true for the type of logic homo sapiens uses.

That does not happen to be the highest level of knowledge. The highest level of knowledge is the potential of – it’s an action definition – the potential of knowing how to know. And that consists of simply the potential of knowing how to know. I’m sorry, but that’s all there is to it. And how do you know? Well, in order to know how to know you have to be free to postulate knowledge. And the freedom to postulate knowledge creates the data which then arranges itself as bodies of knowledge. So, you want to know what your highest echelon of knowledge possibly could be? It would probably be complete freedom to make the postulate to form any datum or group of data without even making the postulate to do so.

And that would be knowing how to know. So Logic One should be rewritten: Knowing how to know is the definition of the highest level of knowingness. And that level of knowingness is the freedom to state a postulate which then can become knowledge. Now that’s very simple.

 The church of Scientology, by its actions every day, condems this LRH statement of purpose for the entire subject as the worst kind of heresy.

I have been working steadily and will continue to along the following lines in order to make the attainment of that statement of purpose possible:

  1. Differentiate the subject of Scientology from the Church of Scientology.
  2. Differentiate L Ron Hubbard from David Miscavige.
  3. Sort out confusions in the murky 81-pt period as to what is Scientology and what are clever alterations intended to reverse its potential.  Despite what some vehemently assert – and rather accusastively toward those actually working to sort it out – LRH Tech compilations were many years behind LRH’s advices for updates (see Joe Howard’s article at Scientology-cult.com for more detail). So, that is no easy task. And no, it won’t get done by an internet discussion group attended by any Tom, Dick or C of M plant having an undirected free for all. 
  4. Make LRH tech broadly available so as to make Ron’s postulate that “the work was free” stick.  Which is my proof that my intentions as to #3 are untainted by financial or status considerations.
  5. Make it safe to practice Scientology outside the wall.

 

In a phrase, preserve the legacy of the tech.

Oh yeah, sometimes I gotta shake the cur dogs off my pant leg rather violently.

Blood Money

Having recently recognized the depravity with which Miscavige and OSA are executing their programs to destroy me and other friends, I’ve thought more about the manner in which the RS enablers are being handled.  I think we are being are being far too timid and mild about the well-heeled bots who continue to contribute to Miscavige’s billion dollar facade and Black Ops.

I hear the arguments go something like this: well, they are well intentioned just like we were when we were bots.  There are a couple things wrong with that argument.  First, assumed identities are not the same.   When we were bots the following was evident to staff and public:

a.  Services were being delivered in orgs.

b. There were public in orgs.

c. There were large-scale attacks by well-funded enemies who sought to destruction of the religion of Scientology.

d. There was a scintilla of substance to the propaganda events.

e. There was no hard facts, evidence and first-hand testimonials readily available from top members telling the real scene.  Yes, there were high level “defectors”, but they had the credibility level of Miscavige having adopted the same vicious, innuendo-laced diatribes full of disprovable falsehood. And they did generalize their attacks toward the destruction of Scientology itself.

f.  People were not being extorted to hand over huge sums – driving them into bankruptcy or worse –  in the most off-policy fashion. Incidentally, reports are surfacing that the church is encouraging “OTs” to declare bankruptcy when it gets too tough, because after all “the suppressive bankers are to blame.” And “OTs” are dutifully passing it along to their fellows.

g. The technology of Scientology – at least to some degree – was available in the churches.

h. Disconnection was a voluntary decision made when one hit a unresolvable snag in case progress; not an enforced policy widely applied for one evil purpose: to block the flow of TRUTH in order to keep the sheep in the pen for repeated shavings.

My thoughts along this line were re-inforced when I reviewed a number of recent credible reports I’d received on the state of orgs.  THEY ARE EMPTY people.  Yes, the Idle ones too.  New York, LA, Steven’s Creek, Seattle, London, Madrid, Malmo, Las Vegas, you name it. I’ve received first-hand reports on all of them.  And they do not deliver Scientology. They deliver some new freaky Miscavige Div 6 mini courses and they do not train auditors.   I realized that if I’d have encountered a church of Scientology in the need of change state of mind I was in when I joined in 1977 TODAY, I wouldn’t go into one even if they had a gun to my head.

The church is dead.  Those who cannot see it are not Scientologists.  They are out-ethics, status oriented, weaklings who don’t have the confront to have an independent thought.  

Which leads to the second problem in treating them like poor misguided children.  Let’s look at Apartheid.  It was extended for many years by sincere pleas of  “well meaning, good South Africans.”   I witnessed it first hand.  Yes, many of them  were seemingly “well-intentioned” and were decent people within their educational and experiential framework.  But, it was not reasoning with such that ended Apartheid.  No, it was telling them evil is evil, whether dressed up in good intentions or not.  It was only when enough people stopped being so confounded reasonable (in a bad sense) about the matter, and started making responsible those who enabled the government of South Africa to continue the hellish practice that the tide began to turn.  And it was only when that escalated to passing laws around the world making it illegal to continue to contribute to South Africa’s economic slave masters that freedom was finally achieved.

Maybe some of you have the time to continue to treat them with kid gloves. I do not happen to have that luxury at the moment.  Their contributions of energy are being used largely to put period to us. And believe me,  if I am ever muzzled, Mike will be next, then another, and another. And guess what?  The forces of evil will have achieved LRH’s warned doomsday (a Black Dianeticist successfully monopolizing the subject of Scientology to the detriment of humanity). 

I am not countenancing counter-productive clownery – like beefing up their serv facs by obnoxiously denigrating people’s beliefs. 

I guess all I am suggesting is that people become more vigilant.  Perhaps we can be a bit more assertive on a one to one basis in pointing out the evil that bots are perpetuating by enabling it. 

Bull Conner was damn certain he was doing the right thing by beating women and setting attack dogs on children in Alabama in the early sixties.  He was probably a great guy to have a drink with if the subject of segregation never arose.

But patty caking Conner would have perpetuated American Apartheid for years.

I am suggesting for starters that we call blood money what it is,  “blood money.”

RTC is dead

 

There is an RTC ”mission” that has turned into a full time affair attempting damage control on the Independent Movement. It is headed by two long-time RTC staff, both of whom ironically I had to handle numerous times on disaffection with Miscavige over the years. They are Stahli (Hansuili) and Sutter (Mike), Miscavige’s SS. SS describes their intent and function. According to Wikipedia, “SS is well known for establishing the police state of Nazi Germany and suppressing all resistance to Adolf Hitler through the use of security forces, such as, the Gestapo.”  Take away their 1.1 introductions smarmy justifications, replace “Nazi Germany” with “Radical Scientology”, and replace “Adolf Hitler” with “David Miscavige” and Stahli and Sutter (and Marion Pouw of RTC, all the OSA External Security and Intell staff, and local MAAs they call into termporary service) constitute a modern day version of Nazi German SS in intent and function.

While the RTC SS is a nasty piece of work, it is nothing to fear. The Scientology field that they are desperately trying to intimidate is far more informed than the general public in Nazi Germany were. And so their confrontations are more Keystone Cops than blood curdling Gestapo.

I was in the Sea Org for twenty-seven years and never, never did I see such an incompetent couple of bumbling fool missionaires last more than a day or two without being recalled. DM has had them out for nearly a year. That is an indication of just how far DM has burrowed into his bunker. A video tape was forwarded to me by two alert public that captured one of their attempted brainwashing sessions. They are laughable.

Sutter and Stahli are defending such an indefensibly criminal organization, they constantly sound as if they are tip-toeing around a floor covered with egg shells. They talk in generalities, they deal in platitudes. When confronted with any of the important truths we’ve disclosed on this blog, they stammer and stumble like Ralph Kramden when he was being dressed down by Alice.

In terms of overall effectiveness they are a Treason mission from Miscavige’s perspective. From our point of view they are Power. They push more people into becoming independents than they pull back into the sheep pen. I have collected far more valuable evidence on DM from them than they could ever dream of collecting on me.

If the Miscavige SS comes calling, I highly recommend you see them and ask them some piercing questions. Watching what are now considered the heavies squirm like earthworms can be quite entertaining. It can also do wonders for your own de-PTSing process.

All sarcasm aside, RTC is dead.

Headley case dismissals – blessings in disguise?

 

I know there has been a lot of rumor, gossip, and speculation (spiced and spun by OSA operative propaganda) with respect to the meaning of the LA Federal Court order dismissing the Headley lawsuits.

I’ve had time to analyze the ruling and am weighing in now. While my opinion in some ways is humble, I cannot deny my twenty-two years experience in litigating the precise issues at hand, so please excuse the righteous assertions of indignation that may might find expression herein.

First, when I read the Headleys’ complaints nearly two years ago, I predicted the result would be much like what Judge Fischer ultimately dished up. It did not mean I was in agreement with it. It meant I knew what the Headleys’ signed over the years. I helped draft or approved every one of the self-serving documents SO staff are required to sign and they were very carefully designed to strip staff of their fundamental civil and human rights. I also knew the precedents we in the church had vigorously fought to obtain over the past two and one half decades. I also knew how outgunned the Headleys were in terms of representation. When it came to Summary Judgment time, and I saw the wall of lies the church put forth to defeat the Headleys’ I provided my own declaration to expose that, knowing it was a long shot, but nonetheless the right thing to do.

Having studied Judge Fischer’s ruling on summary judgment, I have another prediction. That is the Ninth Circuit Court of Appeals will strike her ruling down in such a fashion as to create high court precedent that will make David Miscavige rue the day he spent five to ten million dollars in perpetrating what amounts to a fraud upon the court.

At the risk of offending people, I need to talk about politics for a moment. Whether you like this or not, the following is a FACT. Every major judicial decision – if there is an exception or two I cannot think of them off hand – of import that the church of Scientology has obtained over the past thirty years was handed down by a right wing conservative. I know it might sound counter-intuitive at first. But it is the case. Even while in the church, and an imagined beneficiary of such rulings, I came up with an explanation for this.

Conservative judges are trained doctrinally to be “strict constructionists.” That means – don’t forget your Science of Survival – they are trained to read and apply the law quite literally. Any “liberal” judge who uses reason to interpret the law and constitution in a manner that serves the late Justice Brennan’s motto “where there is a wrong there is a remedy” – usually in a way to protect the minority or the little guy (one reason the Constitution and the Bill of Rights were drafted in the first place) – is viciously condemned by conservatives as a “Judicial Activist”. Judicial Activists are then barraged with well-financed far-right propaganda as being somehow socialist, communist or worse. It is about as fair as saying that Strict Constructionists are Fascists.

As with most isms and labels, neither extreme is very productive. Sane Strict Constructionism often protects honest, productive corporations and small businesses from the havoc that dishonest, yet convincing shysters can wreak. Sane Judicial Activism, on the other hand, often protects our democracy from empowering corporations to so abuse the public as to create a literal Fascism.

It just so happens that Judge Fischer (A George Bush Junior team appointment, a judicial appointment team who was so “strict constructionist” doctrine oriented as to be scandalous in a society with a braver press corps)  is not a deep-thinker nor one inclined to find ways to fashion a remedy where clear wrongs are apparent, particularly when a well-heeled corporation is on the defense side of the courtroom. Her ruling reflects that.

 It is as shallow as a West Texas pig’s wading hole in late August.

 She reasoned, in essence, that the Church of Scientology may visit whatever horrors it wishes behind its walls so long as it claims it is done pursuant to religious “scripture.” I happen to know that that utterly ignores an eighty year string of judicial precedent that requires such an analysis to include this inquiry, “is that religious belief sincerely held.” Fischer’s ruling is bereft of that discussion. For good reason, if one wants to punt a controversial, toughly-fought case out of one’s realm of responsibility.

Worse, Judge Fischer also ignored a twenty-three page declaration from me that detailed how in fact the acts complained of by the Headleys were not only not done pursuant to any religious “scripture”, but instead were done in violation of the letter and spirit of fundamental Scientology scripture.

One of the problems with radical Strict Constructionism (and radical Judicial Activism for that matter), is that extreme doctrinaires (or the not quite bright or courageous wanting to stay hidden in his or her own ideological camp) will ignore the facts to get at the politically correct result. Fischer couldn’t have done a more blatant job.

It just so happens that the Ninth Circuit Court of Appeals (which covers the Western United States) is probably the most liberal Circuit Court in America. Several times over the past three decades the Church has won some “great precedent” in LA Federal Court, only to have it reversed by the Ninth Circuit. Given that our judicial system has become generally more conservative and less responsible over the years, I reckon the chances are Seventy-thirty that Fischer gets reversed.

But, something interesting occurred to me in studying all this and re-immersing myself in the foggy world of courts and the First Amendment. That is, David Miscavige better pray to God that my prediction is accurate. Should the Ninth Circuit punt by affirming Fischer, or deliver an even better reasoned opinion upholding Fischer, Fischer’s ruling will be the most current constitutional law as applies to the Church of Scientology. Why should DM fear that?

If Fischer’s ruling becomes law, RTC will become virtually powerless to seek the courts’ assistance in blocking, or even harassing, independent delivery of the religion of Scientology. To quote Judge Fischer:

“Entanglement issues arise whenever the Court must ‘evaluate religious doctrine or the ‘reasonableness’ of the religious practices followed by the church.’”…

“In other words, “it is not only the conclusions that may be reached by the court which may impinge on the rights guaranteed by the Religion Clauses, but also the very process of inquiry leading to findings and conclusions.”

“Defendants here represent that the challenged conduct was doctrinally motivated. Therefore, inquiry into these allegations would entangle the Court in the religious doctrine of Scientology and doctrinally-motivated practices of the Sea Org.”

In other words, my words this time, if RTC wants to bring a case that in any way opens up an inquiry (even if raised by – as occurred in Headley v RTC – the defendant) into your practice of Scientology when your practice is Scientology doctrine-motivated, they will swiftly be shown the door by the court.

Think it through for yourself.
